Here are the types of personal injury cases that we handle at the firm.

High Stack Areas of Practice

Serious Injury & Death

High Stack Investigates cases arising from automobile and commercial vehicle accidents, pedestrian accidents, trucking safety violations, traffic signal malfunctions, roadside hazards, train accidents, pool drownings and accidents, spinal cord injuries, boating and personal watercraft accidents, wrongful deaths, electrocutions, burns, and brain injuries.

High Stack has attained numerous multi-million dollar results. Among them, Mr. Stack attained a 9 million dollar result for the amputation of both legs of a 36-year-old man. The case involved the sale of alcoholic beverages to a person whom the bar knew or should have known was an alcoholic and who often became inebriated in the bar.

Mr. Gordon’s background prior to law school was in psychology and counseling, and he has used his passion for psychological injury specializing in cases involving brain injuries. While it isn’t possible to count, Mr. Gordon has successfully litigated more than one thousand cases involving brain injury. In addition to brain injuries, Mr. Gordon handles product liability cases where he takes on the major car companies and other manufacturers where people are seriously injured or die as a result of defective products or failure to warn of known defects and dangers.

Medical Negligence

High Stack has successfully concluded many significant medical negligence cases where serious injury was caused by substandard care by medical specialists and hospitals. Prior to joining the firm, Mr. Gordon specialized in medical negligence litigation and has obtained many favorable results, including a 4.5 million dollar settlement in a case where a young girl was left paraparetic from the waist down as a result of failure to follow the prevailing standard of care when her sensory evoked potential dropped during scoliosis surgery and placement of Harrington rods.

Brain Injury and TBI

Trauma to the brain can occur during an automobile accident when the skull strikes, for example, an object like a steering wheel or windshield. There may or may not be an open wound to the skull due to the accident, however in automobile accidents, the skull may not necessarily need to have been penetrated or fractured for a traumatic brain injury to occur. In the case of an automobile accident the sheer force of the accident can cause the brain to collide against the internal hard bone of the skull. The reason why this can occur is that when a moving head comes to a quick stop, the brain continues in its movement, striking the interior of the skull. This can cause bruising of the brain (referred to as a contusion) and bleeding (brain hemorrhage) which may not be visible at the time of injury.

Blunt trauma is a more serious type of head injury that can occur in an automobile accident when a moving head strikes a stationary object like the windshield, where the head is impacted causing an open wound which can be sustained from a variety of sources such as roof crush or occupant ejection in a car accident. At impact the brain opposite the site of impact is pulled away from the skull, injuring the brain there.

When a traumatic brain injury, spinal cord injury or any type of severe injury in which the occupants of a motor vehicle have sustained serious, debilitating injuries severely affecting their way of life, there are a number of factors that should be evaluated. In some cases, the extent of the injury may have been more severe due to outside factors that contributed to the accident.

Business Litigation/Insurance Disputes

High Stack also accepts select contingent fee cases involving significant contract disputes, business torts, class actions, professional negligence, and claims against life, health, and disability insurance companies for bad faith and failure to pay benefits.

Automobile/Motorcycle and Boating Accidents

Through the years, High Stack has handled hundreds if not thousands of accidents involving automobiles, motorcycles, and/or boating accidents. With millions of automobiles traveling the Florida roadways every day, it is not surprising that several thousand people each year lose their lives as a result of automobile crashes, and many thousands more are seriously injured. Injuries resulting from automobile accidents not only cause physical injury, but they most often cause emotional and financial strain as well. Automobile accidents often leave a person unable to work or unable to perform their usual duties at work, which causes financial hardship for families. In many cases, serious injury or death of a loved one will leave a family without the financial means necessary to survive. High Stack has helped those people and families for more than 60 years to recover the money due to them as a result of the accident and to help restore financial security.

In Florida, as in most other states, when operating an automobile, a person has a duty to exercise reasonable care in the operation of their vehicle. When a person fails to exercise reasonable care and causes an accident, that person is considered to be negligent. The law allows for a claim to be made against the negligent person. The attorneys at High Stack understand and know the law and are there to preserve and protect your rights.

Through hard work, skill, and dedication, the attorneys at High Stack have earned a reputation in the community and among insurance companies and their peers as being leaders in handling automobile cases and complex cases.

If you or your loved one has been injured by a car, commercial vehicle, motorcycle, boat, or truck accident, call the attorneys at High Stack to learn whether you have a claim and the value of such a claim.

Products Liability

High Stack has handled many cases during its 60-plus years involving defective products that caused serious personal injury or death. Litigating cases and taking on large corporations in product liability cases requires great expertise and financial fortitude. High Stack and its attorneys possess the skill in both the litigation process and a jury trial if necessary, as will the financial backing to represent people injured or the family of those wrongfully killed due to defective products.

During his entire career and continuing today, Mr. Gordon has handled numerous complicated products liability cases where he has enjoyed great success in achieving the best possible result for his clients. A sampling of High Stack’s accomplishments in the products liability arena includes a 3.5 million dollar result against General Motors when a young woman was paralyzed as a result of a defective design in the cab of a Chevrolet Pickup and a 3 million dollar result against a major manufacturer of heavy-equipment due to a defect in the gear system of a certain piece of equipment.

Mr. Gordon has enjoyed much success in the products liability arena. His accomplishment in this area includes a $1,920,000 result against the maker of a tire and truck for a case involving a tire separation and truck rollover causing a mild brain injury in a young woman, along with a 1.335 million dollar result against the maker of a construction equipment hoist when, as a result of a gear failing due to imperfections in the production process, a hoist was caused to fall to the ground severing the arm of the occupant.

Civil rights/Sexual harassment

The attorneys at High Stack believe strongly in protecting peoples’ rights. Mr. Gordon has handled cases involving traditional and sexual harassment where a woman is harassed in a sexual manner by either a co-employee or supervisor. He has also successfully handled less traditional sexual harassment, such as male-on-male sexual harassment. The law governing sexual harassment and discrimination is known to few attorneys. High Stack is familiar with this emerging area of the law.

Mr. Gordon litigates landmark civil rights cases. The firm represents a six-year-old young child who is believed to be the youngest person ever tasered by the police. The case grabbed local as well as national media attention, focusing on the issue of police and their use of a Taser as a weapon of first resort rather than a weapon of last resort. In the case of this young boy, the tasering occurred in the principal’s office at the elementary school he was attending. Mr. Gordon prevailed in overcoming qualified immunity and holding the police accountable and is responsible for the first opinion of the 11th Circuit Court of Appeals regarding police policy for the use of a Taser.
